All right country people-- how bout you all weigh in on this conundrum for me. Especially you country people that are also hunters
Say you own some property--enuogh of it that you do not see it every day. It is fenced however, and there are occasional signs that say no trespassing (which would encompass no hunting I would think). You have denied people access to hunt on the land before--for the obvious reasons of it being dangerous to your livestock.
In your adventures on your own property, you find not one but two deer stands. You do not know who put them there, but you know it was not you and you know you did not give anyone permission to do so. You do not therefore, know who did it.
What are your options? Are you justified in removing them? Is this a risk the putter-uper knew he was running when he put them on property he knew was not his and knew he did not have authority to enter, let alone hunt on?
What is the general concensus on this matter?

I would think you would be justified in removing them, after all it IS your property. I would also post no trespassing signs in their place and maybe more signs along the fence. In AR you have to have markings (no trespassing paint or signs) every so many feet or it's not enforceable. We bring all our horses to within viewing distance of the house during hunting season due to people ignoring the no hunting/trespassing signs.
I would tear those suckers down and burn them if they're wood or sell them if they're the metal kind. If someone comes along asking you about them tell them you know nothing about deer stands on your property and that you don't authorize hunting on your property and therefore would not expect to find any deer stands anywhere on your property.
This thought just came to mind. Why don't you remove the stands and leave a note with your name and phone number in their place. That way they can call you to retrieve their deer stand at which time you can inform them of your no hunting policy and have them sign a statement indicating they were informed of your no hunting and no trespassing policy before you'll release their property. Might be the more neighborly thing to do if you think it's a local person. That way if you ever catch them on your property you have grounds to have them arrested for trespassing.
Hey Paige. At our house, we take them down. No one has ever been brave enough to come ask for them back and our name/number is on the no trespassing signs so they do have to opportunity to do so. Cowards. :)
I would call the police and report it and then ask them what they would recommend me to do legally to remove it. I am sure they would say it is okay but I want their support if it becomes an issue with an irate hunter looking for his prized deer stand. Maybe, even ask the police to take it with them and then if someone wanted it back they would have to go and get it from the police dept. I would be closely watching that area to make sure if they came back, I would have a better idea of exactly when they visit and maybe catch them.
I need to venture out and check our back property again. Last year we found a stand and bait and in my state it is illegal to hunt over feed. We pulled the stand down since we would have been the ones arrested for hunting over bait if the DNR came looking.
Deer stands what deer stands LOL.. Those things never see light again if we find them.. We have a lot of acres and find signs of people all the time it is immpossible to keep idiots off your land.. But its impossible for us to remember where the *H* we misplaceled there left behinds... I imagine if your hunters can't locate there stuff they'd not be dumb/ballsy enough to come asking.. And if they did Deer blinds what deer blinds of course than I'd tell then your
attorney and you'd like to know how come they have lost there stuff on land you clearly did not allow people to hunt on..
Hey you could put it all in a stall tell them its funny they took so long to come pay there boarding fee for the stuff hand them big detailed boarding bill LOL..
I would take them down and leave them a note with a phone number like Shell said, only I would give the number of the local police.
we get this all the time at work during deer season. No trespassing is better than no hunting. We can enforce the no trespassing but the Game commission has to do the no hunting.
As for deer stands...what stands? I don't see no stinking deer stands.
I'd take them down. It is your property and they don't have permission to be there. I'd put up No Tresspassing signs and alert the police and the game peeps.
Not that any of it will do much good but ya never know. I had 6 deer jacked and left on property I was renting for my horses. No one would do a thing about the dead nor about ppl cutting my fences and hiking through.
On a fine technicality, I would also post a NO HUNTING sign as well as NO TRESPASSING. Now they will tear these down and deny they were there. Use PAINT on something close. Call Illinois Dept of Conservation-Game Wardens don't have number handy-will call Son, and yes take down stands, and that may stop them, cause they do cost money. But-------they will be back as the season is returning.
